Terms and Conditions

1. By installing and using the mobile application (“App”) of HKUST Entrepreneurship Center (the “Center”), you hereby agree and accept to be bound by these Terms and Conditions of Use (“this Condition”) and the Data Privacy Policy Statement (“DPPS”). Please review them carefully before installation and/ or acceptance.

2. You must follow and comply with all applicable laws and regulations of the Hong Kong Special Administrative Region when using this Service.

3. You acknowledge and agree to check this Conditions and DPPS periodically from time to time. The Center reserves the right at its sole discretion to amend, change, suspend, redraw or otherwise alter any aspects of this Condition and DPPS without prior notice to you at any time. Your continued use of this App following the posting of changes or modification will mean that you accept any changes or modifications in this Condition and DPPS.

4. In order to use this App, you are required to have a compatible mobile smart phone, mobile device or mobile network, up to the configuration standards with Internet connectivity.

5. The compatible mobile devices are required to be operated by Andriod Kitkat (API 19) or above; or Apple’s iOS 11 or above; or other systems which we may designate from time to time. The version of the App may be upgraded from time to time to add support for new functions and services.

6. You must register an account to use the services on this platform. For current UST members (Students and Staff), please use your ITSC account to verify your identity during the registration. For UST alumni and non-UST members, please register a non- UST account.

7. You acknowledge and agree that you will not nor allow third parties on your behalf to (i) make and distribute the copies of the App; (ii) attempt to copy, reproduce, alter, modify, reverse engineer, disassemble, decompile, transfer, exchange or translate the Applications; or (iii) create derivative of any kind whatsoever.

8. You acknowledge and agree that there would be some events or programs only open to a specific group of users (e.g. Current Full-time UST Student only). Please refer to the eligibility of each event and program for details.

9. You shall make sure the information you provided is correct and up to date.

10. For current UST members, the student information will be automatically retrieved from the HKUST student database to simplify the registration process and to provide your better user experience. The information includes but not limited to name, school, major, study year, etc. You may review this information in the profile function in the platform.

11. You shall provide your contact info such as your preferred email address and phone number for the Center to reach you in case there are any emergency updates on our services.

12. .You shall be liable for and shall fully indemnify the Center against any loss or damage or expense caused to the Center by reason of your prohibited or illegal acts, unauthorized uploading or downloading, or infringement of intellectual property rights.

13. You acknowledge and agree that the Center owns all of the information, materials, trademarks, logos and service marks contained or displayed in this App, which may not be used, reproduced, distributed or published in any medium for any purpose without our prior written permission. Where any information or software is downloaded from this App, you agree that you will not copy or remove or obscure any copyright or other notices or legends contained in any such information or software.

14. You acknowledge and agree that this App is provided on an “as is” basis without warranty of any kind, either express or implied, and are subject to change without prior notice. The Center does not guarantee or warrant that your use of this App will be uninterrupted or error-free. The Center makes no warranty whatsoever regarding non-infringement of third party’s rights, security, accuracy, and completeness, fitness for a particular purpose or about the accuracy, reliability, completeness or timeliness of the contents, services, text, graphics and linkage to this App.

15. You acknowledge and agree that you access external sources including but not limited to websites, hyperlinks, resources, external information and any external mobile applications which are linked to or provided in this App at your own risk. To facilitate your access to information provided by or via other parties, this App may provide links to external websites through its content merely for convenience purposed. Provision of these links gives rise to no statement, representation or warranty, express or implied, that the Center agrees with the contents of any external sites. The Center has no control over the information, materials or services contained and displayed therein, and the Center will not have or accept any liability, obligation or responsibility whatsoever for any loss, destruction, or damage (including but not limited to direct or indirect, special or consequential loss, destruction or damage) howsoever arising from or in respect of any use or misuse of or reliance on the contents of such external websites via this App.

16. .You acknowledge and agree that you may be charged by your respective mobile service providers for network access or any such third party charges when using the App (including but not limited to roaming charges and data charges for access to network connection services). You are fully responsible for any such charges that may occur. The Center will not have or accept any liability, obligation or responsibility whatsoever for any charge or loss howsoever arising from or in respect of any use or misuse of this App.

17. The Center reserves the right to do any of the following, at any time, without prior notice or any reasons (i) to remove the App for an indefinite period of time or cancel this App; (ii) to amend, suspend, withdraw or terminate operations of or access to perform routine or non-routine maintenance, error correction, or other changes or otherwise; and (iii) to modify or change this App. You acknowledge and agree that the Center will not be liable to any party for any or all of the actions referred to in this paragraph, or otherwise.

18. You acknowledge and agree that the Center will not have or accept any liability, obligation or responsibility for any loss, destruction, damage or indemnifications (including by gross negligence) whatsoever and howsoever arising or resulting from or caused by (whether direct or indirect, special or consequential or incidental to) the installation, ability to use, inability to use or improper running of this App or contents being unable to be downloaded or lost internet activity or interruptions, delays, defects or omissions that may exist in this service, information, materials or other contents provided in this App or any external mobile applications or websites so hyperlinked to this App or its contents. Communications may be subject to interruption, transmission blackout, delayed or failed transmission and incorrect, erroneous, omitted or loss of data transmission. The Center will not have or accept any liability, obligation or responsibility whatsoever for malfunctions in communication facilities not under the Center’s control that may affect the matters in this clause.

19. You acknowledge and agree that you are solely responsible for ensuring adequate protection and back-up of data, information and/or equipment, and for undertaking appropriate precautions to scan for computer viruses or other destructive properties. The Center does not guarantee that no viruses or other contaminating or destructive properties may be transmitted through this App, or that no damage will occur in your mobile phone or any other devices.

20. When you use this App, the Center may collect and process information about your application of events/programs for the purpose of internal analysis and enhancing the upcoming events.

21. The Center may terminate use of this App at any time without giving prior notice or reasons of termination to you.

22. The Center reserves the right to amend the terms and conditions at any time without prior notice.

23. In case of any dispute arising from use of this App, such as selecting the participants, disqualifying registration or participation, and any rules of specific event and program, the decision of the Center shall be final.
